Sioux Falls teen who took a plea deal with prosecutors following a shooting death near the Empire Mall was sentenced Tuesday afternoon.

Robert Montes was sentenced to 5 years in prison. That is the maximum sentence he could receive under the deal. He pleaded guilty to being an accessory to a felony and had murder and manslaughter charges dropped.

The other teen charged in the case, Conner Hanson, was on trial last week. A jury found him not guilty of murder and manslaughter in the shooting death of Anthony Gabriel.

According to the Associated Press, Montes asked for his plea deal to be tossed out after jurors found Hanson not guilty of all charges last week. Prosecutors argued that the outcome of Hanson’s trial had no bearing on Montes’ plea deal.
