A loose end is one step closer to being tied. Soon the case of the bulging PREMIER Center panels will go through the legal process.

By all accounts the Denny Sanford PREMIER Center has been a resounding success. However there is the matter of the panels that still needs closure. The City of Sioux Falls released a statement on how it will proceed.

Approximately one year ago, the City of Sioux Falls opened the Denny Sanford PREMIER Center, which has hosted numerous public events and improved the quality of life for the citizens of Sioux Falls and our region. While the overall project has been a huge success, the issue involving the exterior metal siding has not been resolved.

Contract documents allowed the City of Sioux Falls to engage in an informal resolution process to reach an acceptable solution to the metal siding issue. For the past 12 months, discussions took place with M.A. Mortenson Company, Sink Combs Dethlefs PC, Koch Hazard, M.J. Dalsin Inc., and Innovative Metals Company Inc. (IMETCO), in hopes of resolving this matter without the need for litigation. The informal resolution process yielded results, as the discussions led to an agreement on settlement terms among all the parties. Settlement documents were drafted and approved by all parties. However, now one of the parties has refused to execute the settlement agreement.

 

The City of Sioux Falls is joining with Mortenson, Sink Combs Dethlefs, Koch Hazard, and IMETCO to commence legal action against M.J. Dalsin to enforce the terms of the settlement agreement all parties had negotiated and agreed upon in May 2015.

“Because this is pending litigation, the City of Sioux Falls will not make any comments on the merits of this litigation,” says David Pfeifle, City Attorney. “We will respect the judicial process and allow the matter to be decided by the courts.”

Jared Kuik the Operations Manager at M.J. Dalsin still has a positive outlook for a resolution. "We're still hopeful at M.J. Dalsin that we can work out a settlement agreement and come to a conclusion on this wall panel issue with the city even though we didn't design, specify or install the panels. M.J. McGrath out of Maplewood, Minnesota was the company that did the west radius wall."
