A late September incident involving a college professor and South Dakota Legislator-elect leads to a November arrest.

One day after being elected to the South Dakota Senate from District 15, a warrant was issued for the arrest of 50-year-old Reynold Nesiba of Sioux Falls. He is charged with sexual contact without consent.

Nesiba’s Monday arrest comes on the heels of running unopposed in his bid to serve in the South Dakota Legislature. The economics professor was also involved in the recent attempt to cap payday lending rates at 36% and a previous campaign that raised the minimum wage in South Dakota.

This incident stems from a report to police that occurred on September 28. The sexual contact without consent charge is a class one misdemeanor with a maximum sentence of one year in prison and/or a $2,000 fine. It is initially unclear how this will affect Nesiba’s status as a member of the South Dakota Legislature.
