I first saw this story from Time.com and couldn't believe the result.  In today's America, someone that sued a corporation didn't win? Did I read that right.

Apparently, so.

Apparently, you cannot not sue Applebees if their fajitas burn you while you are trying to get dinner.

The victim Hiram Jimenez alleged that when he bowed to pray over his plate of fajitas at Applebees that the hot oil from the sizzling plate shot up and hit him in his face causing burns.

He then claimed that he panicked and the rest of the sizzling hot plate fell into his lap.

He went on to claim that he suffered burns to neck, arms and face.  Furthermore, Jimenez claimed that the waitress failed to warn him that the plate was hot.

According to latest US News, when the case went to Superior Court, the judge refused to agree with Mr. Jimenez.  Instead, the Judge ruled "that the dangers of a sizzling plate were “open and obvious,”.

Nice to see a judge in civil court with a bit of sense considering all the nonsense that makes it way to our courtrooms these days.
