A South Dakota farm partnership says a lawsuit by a North Dakota farmer over allegations of stolen soybeans is frivolous and the group is still owed money for the crop.

A federal complaint by Glenn Herr, of Wishek, North Dakota, accuses Cornhusker Farms of Bath, South Dakota, and a private investigation firm of wrongly blaming him for stealing a $10,000 truckload of soybeans.

Herr says he was charged with the theft because of malicious and false statements by the defendants and says the contract and documents supporting him were intentionally withheld. The charges were eventually dismissed.

Cornhusker Farms says any liability rests with the private investigator and have filed a counterclaim against Herr for the soybeans.

Zylstra Investigations, of Aberdeen, South Dakota, says Herr's allegations against them are "made without reasonable cause."
